Cancellation, in our opinion:
Non-U.S. citizens who have been placed in removal proceedings, often known as deportation proceedings, may be eligible for cancellation. It is open to both lawful permanent residents and people who have never been awarded a green card in the United States. If a person is awarded cancellation of removal, the Immigration Judge will cancel their removal from the United States and enable them to remain in the country lawfully.
Non-U.S. nationals who have been placed in removal proceedings, also known as deportation proceedings, may be eligible for cancellation of removal. It is open to both lawful permanent residents and people who have never been awarded a green card in the United States. If a person is awarded cancellation of removal, the Immigration Judge will cancel their removal from the United States and enable them to remain in the country lawfully. Only an Immigration Judge has the authority to grant a person relief from deportation.
Permanent residents seeking cancellation of removal face different requirements than applicants who have never received their green cards. Please see the sections below for further information on this vital source of assistance.
Permanent Residents Cancel Their Removal
If a lawful permanent resident, also known as a green card holder or immigrant, is found to be inadmissible to the United States or at risk of being deported, they may be placed in removal proceedings. This could occur as a result of a person’s criminal record. Many permanent residents facing deportation are, fortunately, eligible for a stay of deportation.
Please keep in mind that the 5- and 7-year periods, as well as whether a criminal conviction qualifies as an “aggravated felony,” are all subject to complicated legislation. To discuss these difficulties, you should speak with an expert immigration lawyer.
Located in Hempstead, Shankar Immigration Law Group is a full-service immigration law firm.
